Need Emergency Protective Order but have no proof. What do I do?

The brother of my sons father, while I was pregnant threatened to take my son away from me and even go as far as to frame me with drugs. Now my son is 2months old, and a day ago, he threatened to come over and take my son and run off with him. He said he would do whatever it took to keep me away from him. That whole side of the family has never liked me and have constantly tried to make me seem unfit. My worry is that he might actually try to kidnap my child after that last threat. Since I have no proof of the event except on my own word, can I still get an Emergency Protective Order (EPO) keeping him from being able to come anywhere near my child???

    A day he threatened to? How did he threaten you phone, cell txt how.

    Phone can be traced via call center, txt can be stored in system of your calls?

    Let him try tell local authorities about threats he made and you want a restraining order of 100 yards .

Might want to let the son's father's brother know he's not the father, and it's called kidnapping as a federal offense.  The FBI will be all over him.  I'm almost tempted to tell you to let him do it as he would get serious jail time, except I'd be afraid of what he might do to the child.  Have you called the police yet and reported this?

  4. Yes, you have a legal right to obtain a EPO. The local police, sheriff, or constable must serve it to him in a reasonable amount of time. If possible, move to a safer unknown location, or move in w/ a family member, and tell them to not let anyone know that your living there. Your priority now is keeping your baby safe and with you. If you know that this brother-in law has any outstanding warrants or legal issues, I'd report that right away, and get him locked up. He sounds like a real mental case. Good Luck
