My freind bought this from ebay

He told me he has not recieved it,he payed by bank transfer on the 11th aug the seller keeps saying the payment has not cleared what could my freind do thanks.

  1. Im sure bank transfers take a while to clear, id advise contacting the bank and ask how long they usually take, most sellers wont send items out until payments have cleared. If the bank said it has cleared, contact the seller and tell them, if he doesnt send it out then, take an "item not recieved" dispute out against him, after the required amount of days.


  2. I would log the dispute with Ebay - the option to log this is on the home page.  They advise to contact the seller, but if you are unable to resolve it then they look in to the case for me.

    I went down this route last year after a phone didn't turn up, and they were very good - I received a full refund.

  3. Not been that long so keep hassling seller.

    If you don't get a reply at all then contact ebay and start a dispute resolution procedure.  Be warned that this won't get your money back, ebay can only close down the seller's ID.

    Final option is to threaten court action against seller in the small claims court - google it for more info - quite easy to make a claim and costs about £27 or so depending on size of claim.  You can make the claim online but be careful if you follow this route to follow the procedures exactly (i.e. by giving notice to other party that you are making a claim and giving them 14 days to rectify situation plus your costs).

  4. Seems odd that your friend would choose to pay by bank transfer because the seller doesn't even mention that as one of their payment methods and bank transfer is the last thing that most buyers would opt to pay with, especially an eBay newbie.

    The seller does say they'll accept a bank draft (but that shows by default when the seller says that they'll accept postal orders).  A bank draft has nothing to do with a bank transfer payment.

    Get your friend to check again with his bank again to make sure that he sent the money to the right account.  If he got the details wrong, the seller won't have received the money.

    The above post mentions your friend's ME page.  It would have been interesting to see that but it looks as though your friend has since removed it for some reason.

    I've just had another look at the listing and this all gets more and more odd.

    The listing started at 21:07 on 3rd August and finished with a BIN at 21:48 on the same day, just 41 minutes later.

    The listing wouldn't have been fully indexed (and therefore 'searchable') in such a short space of time, so how did you friend even find it?

  5. I use e-bay fairly frequently and have looked back at the item you have refered to.

    On the face of it the seller has a pretty high positive feedback rating which seems reassuring.

    Also the purchase seems to have been completed on a 'buy it now' basis from a UK based seller. This is also reassuring.

    The volume of the e-bay trade carried out by the seller seems to suggest they would be classed as a dealer/ trader regardless of how the seller might describe themselves or what the seller might claim. Some people try to say they are private sales but the volume suggests differently.

    The combined effect of all this is that as a dealer and a buy it now transaction all your rights under the various sales of goods legislation apply. This includes the legal obligation of the seller to ensure the safe delivery of the item. Others have correctly said that you have rights if it does all go wrong to take a County Court action.

    Although lots of e-bay sellers try to say that delivery is at the buyers risk this is not what the legislation says.

    Section 20 Sale of Goods Act 1979 as now amended  by Sale & Supply of Goods to Consumer Regulations 2002 says " where the buyer deals as a consumer ... the goods remain at the seller's risk until they are delivered to the consumer"   also " ... delivery of the goods to the carrier is not delivery of the goods to the buyer"

    I do not know of the seller and have no vested interest in the matter othert than the, hopefully, impartial answer I have given to you. Hopefully a few e-mails between the parties should resolve it.

  8. Get confirmation from the bank that the payment was made - you will be surprised at how many times banks don't transfer the funds on time.

    Once confirmation received that the money was paid into the sellers account - confirm it with the seller -

    If the seller still does not do anything - he will need to raise the matter with eBay and report it.

Be patient , contact the seller again and tell them the payment has now cleared and try to get them to confirm that they have received payment.If they agree they have now received payment then get as much information as possible as to how they intend to send the goods and when, if possible get them to insure the goods and get a traceable delivery method.

    Keep your fingers crossed as there are a lot of crooks on e bay.

  10. Has the payment gone out from his bank account? If not, he needs to find out why that is. If it has, maybe he can ask the bank to track it (if possible). If they say it has cleared he will need to go back to the seller.

    If he still has problems, contact Ebay and talk to them. If he paid through Paypal then he is covered and should be able to get the problem sorted.

  11. Your friends first mistake was to pay by bank transfer on such an expensive item, he should have used paypal as by bank tranfer he is not covered.

    I recommend that your friend check to make sure he has a receipt to prove that the money went into this individuals account and then keep pestering the user. If he still gets no response take it furhter with ebay and  they'll prob give you details in which to make a criminal claim.

  12. I have to agree with 'on thin ice' above. The seller looks good.

    I took a look at the buyers about me page and feedback too - the buyers about me page is all about what payment methods to use and he only has 7 feedback. I can only take what people have said at face value but looking at the two (the buyer and the seller) it's the buyer who looks a bit 'dodgy'.

    Sorry but that's my personal opinion just looking at the two users reputations (feedback amount, percentage, recent activity, actual items bought sold etc.).
