My husband just called me and he got into another accident. 2nd one in 2 months. Bad luck or curse??? Some lady driving a UHaul hit his van on the side and drove off. He chase her down and got her. He just wanted her to pay the broken mirror but she don't want to. Tell my husband to call the cop and he did and waiting to make a report. She told him to file a claim with our insurance and my husband say no because she hit him and drove off, we are dealing with her insurance. What do we do? what if she doesn't have insurance? don't want to go thru our insurance because this is a business van and our deductiable is $1000.

  1. ALWAYS get a police report

  2. Please explain: WHY do you purchase INSURANCE?

Answer: So THEY can take care of ACCIDENT reports, claims and recouping monies from parties at fault!

You will spend well over $1,000 trying to COLLECT $235 for the broken mirror. If your husband is that accident prone, I'd pull the keys from him and buy him a bicycle instead. Sounds like he is an ACCIDENT waiting to happen -- twice in 2 months! 'nuf said.

  3. The people that are telling you not to call your insurance...are they in the insurance business, do they actually know what their talking about?  It's very frustrating when people give advice & they really don't know.  Nothing against them if their your friends, but still......?

You pay a premium for insurance coverage, if this woman hit a parked vehicle & left the scene, which is considered a felony (hit/run) she is responsible for all damages to both your vehicle and the Uhaul.

I would first call your insurance company a submit a claim.  If you have the correct coverage they can waive your deductible and start repairs on your car.  Then I would contact Uhaul & submit a claim with them.  In order to rent one of their vehicles your have to show financial responsibility (proof of insurance) or take out their insurance coverage.  This will start the ball rolling.  Also, I'm not sure about the state your in but in Calif. any damage over $750 needs an SR1 submitted.

Cops....normally if they have a unit available they will come out.  Otherwise, they come out when there's injuries or confrontations.

    Hope this helps..

  4.      THE FIRST THING THAT HE DID WRONG WAS NOT CALL THE POLICE.IT DOES NOT MATTER IF IT IS YOUR MOTHER OR NOT YOU ALWAYS CALL THE POLICE.

THE ONLY THING THAT YOU CAN DO NOW IS TO FILE A SMALL CLAIM CASE AGIANST HER.AND IF SHE DOES NOT HAVE ANY INSURANCE THAN THE CAR THAT SHE IS DRIVEING SHOULD BE IMPOUNDED BY THE POLICE.

  5. >>  we are dealing with her insurance.

did this person stick around to give your husband this info?  Then it is NOT hit and run.  If the person stuck around to speak to your husband then it is not hit and run.

    >>  what if she doesn't have insurance? don't want to go thru our insurance because

You either pay for it or let the insurance pay for it.  Then you sue HER in small claims court to recover the repair cost.

    Good Luck...

  6. The lady in the UHaul will have to pay one way or another.  Let your insurance deal with it.  Your rates will not go up, not your fault, and the lady will have to pay.  Your insurance company will go after her.
