Need advice, was in accident, car totalled, no money, what do i do?

I was involved in an auto accident on Friday which was not my fault. My problem is my car was totalled, it was not even a year old and obviously still paying on it. I have about $14,000 left on my loan. I missed work because of my injuries and im the sole provider for my family. I went to the hospital but have no insurance and im dreading the bill.

My question is, the other guy had Progressive, will they pay my medical bills, what about my car, if they issue a check for the worth of the vehicle, will it come to me or my lienholder (bank). Im afraid that it will go to my lienholder because i dont have gap insurance so not only will i have no money for a new car, i will now also owe a couple of thousand for the car that just got wrecked. This is the only car my family has. So we have nothing to get around in now.

Left with...

No Car

No money to pay off car.

No money to buy new car.

No money to pay medical bills.

What do i do?!

  1. welfare and who crashed who? if he was intoxicated you could sue i think im not sure

His insurance should pay your medical bills and if your car is totaled, they will pay "Fair Market Value".  The check will be given to the lienholder and you will have to keep making payments til the car is paid for.  These are the consequences for borrowing more than the car is worth.   We notice that you have a computer with its related expenses.  Maybe getting rid of it would be a good place to begin with a new more realistic budget?

  3. If it is not your fault, you can claim against his insurance for damage of car, medical bills, renting of car for your work if you need to, etc.

    Claim his insurance and that is what insurance is for.

If the other guy was at fault and he was ticketed for the accident, his insurance has to pay for all of your bills.  Unfortunately, some people don't carry "full coverage" on their car insurance.  If that is the case, then you might have to seek restitution in court.  Either way, if it was his fault he must pay for it!  Don't worry, it will be alright!  I hope your injuries are not too bad and I will keep you and your family in my prayers!  Keep your chin up!

Go get a lawyer that deals in personal injury car accidents if his insurance company gives you any problems.First thing is go to the police department and get a copy of the police report.If he is at fault his insurance has to pay for your car and medical bills,lost wages etc.They will only pay blue book on your car.That money will go to the lien holder to pay off the loan.Any excess will go to you.If he was under insured and you have under insured coverage you can put a claim against your insurance then they will go after him.Talk to your claims agent to help find out where you stand.

  9. If you have a loan on the car, they must have made you get full coverage.  That will cover you and your car.  Anything the other company covers, will be paid to their client, not you.

  10. The other party's insurance company should pay you the value of your car, as well as your medical bills regardless whether or not he has comprehensive. It'll come out of his liability insurance. The check will go to the lienholder to pay off what's still owed, and whatever is left over will go to you.

Since it wasn't your fault, progressive should be covering it all for you, including the hospital bill.  Depends on what kind of coverage the other driver had.  If it was full coverage, you shouldn't have much to worry about.  If they try to deny claims, keep pounding them about it.  You could maybe even come out ahead if you have suing in mind.  You've missed work, etc.  Good luck to you and even though it seems like a gloomy outlook, it should be fine with the other driver's insurance.
