Question:

Need advice on auto accident!?

I rear ended another car. I know it is automatically my fault but the car in front of me was turning at an intersection and she failed to put on her turning signals and also only her left brake light was working. There was a guy who was following from behind for a couple streets back, he saw the whole thing and basically saw that she had no turning signal and I was going under the speed limit (it was snowy-very bad weather). I had very bad back pain and my chest hurts. Can this turn into a case for the courts? Is it my fault or am i the victim?

  1. I would call a few Lawyers and see if they might take the case. I doesn't hurt to ask. Also, they are not going to take a losing case; so you'll know if it would win. It is not in their Financial interest. Also, make sure the they only get paid when you get paid.

    Hope this helps - Matt

  2. Sorry, but it's still your fault, even though the vehicle in front didn't signal. You're supposed to be in control at all times, and be able to stop safely no matter what the person in front does.

You always have to expect the unexpected. People ahead of you can slam on their brakes for a number of reasons - avoiding an animal, a child, pedestrian, another vehicle - or even because they didn't see their turn in time. The driver following should always be able to stop in time.

Just because it's icy or snowy isn't an excuse. You're supposed to allow more distance in those conditions.

  3. I honestly doubt it but you could probably make a case out of his reckless driving.

  4. It will be your fault and they will say that you were too close and not in control of your vehicle for the road conditions.
