Question:

Need help, wrongfully evicted.

Long story short. I lived in a house with my mom. She wanted me to pay her 200 dollars a month of rent every month, so I did. Then this month she got mad at me and wanted me to move out. She gave me a 5 day notice, but since it was a verbal contract that was on a month to month basis. I saw that she had to give me a 30 day notice, according to my states law. So I continued to stay then unexpectedly she had the cops come and they made me leave. They said if I wouldn't I would go to jail. My question is since I was illegally forced to leave my house, what can I do? Who should I report this to? Should I also report the cops? I live in Niles IL, Cook County. Only serious answers, I really need help on this. I asked this question before and got people that gave me there worthless opinions. You don't not understand the circumstance, so don't judge or try to. I just need legal advise, that is all.

  1. Call an attorney for legal advice.  Yahoo answers does not guarantee the advice you get will be lefally sufficient.  All I can tell you is that your mom did not break any criminal laws so going to the cops is worthless.  You could protest your treatment in a civil court but the remedy would only be that she owes you the pro-rated amount of rent you paid for the month---e.g. you paid 200 for 5 days so she owes you whatever the amount is for the other 25 days, but only if you paid for the last "month" you were there.  Even if you get notice of eviction, you still have to pay for the lay period


  2. You explained. You had no lease; it's a domestic matter because your parent was involved. Why else do you think the police told you to leave?
