Need help about car gave away and then violation

Hi all,

I have a question which is hard to anwser, i really need your help. Please let me know if you really know the answer.

I had a car, it was Toyota Cressida(my name in the title). But my dad he said it was too old so he gave it away(well, i paid $800 to fixed that and he gave it away without asking me). He gave it to a guy work at a repair shop. This guy took this car and sold it away for an old man.

This old man came to my house and asked for the title, but i told him that the title was lost, so he asked me the "diver license" so he can go and make a new title.

The point i want to say here is: after that i went to work and my co-worker told me that, what if he doesn't make a new title and somewhere on street he hit somebody by my car?I'm worry about that since then. And now, he does not hit anybody but he ran on toll way without pay the fee, now the letter sent to me and asked me to pay the fine, and the letter scared me that if i don't pay, my license will be suspended.

I'm trying my whole life to live without any violation, but now, this one almost killing me. PLease help me with your serious answer

  1. Your going to have to prove that you sold it (or whatever happened) in order to get out of the violation.  

    I have a hard time seeing how anyone can give away a car (even a parent) when their name isn't on the title....it's not theirs to give away.

    You might be stuck with paying the violation if you can't prove it was sold/given away, sorry


  2. Call the police and file a file to have on record. Also ask them what you can do, since you lost the title to car. Im sorry. Call DMV first.

You never want to give your driver's license away to anybody.  I don;t understand why you'd want to make a new title anyway - I guess to clear things up in case there is an accident, but I don't know if it's legally possible to re-make the title of a car you don't have any more.  Does your father think that you didn't want the car any more?  Why did he get rid of it?  When your father gave it away, he should have taken the license plates as well, forcing the new owner to get new ones.

    Was the car to be junked (if so, your dad made a mistake not even charging the scrap value)?  Was the car given for charity?  (if so, your father should have a receipt for that for tax purposes even and especially of no money changed hands).

    Worse comes to worse, you can file a police or insurance report that the car was stolen, so that you're covered in the event of an accident.

  4. You should have his drivers license number, along with a dated bill of sale. That way, you can prove the car was sold prior to anything that may happen.

    Unless you get that bill of sale, or get him to admit to the violation, you may be stuck paying it.

If you have the information from the old man, then you need to tell him that you recieved the letter and if he doesn't get it cleared up and tell the people that he was the one driving the car and that he bought the car from someone else, then I would let him know that I will turn him in for stealing my car. As long as you never signed over the title to your dad then he never had the right to sell the car to anyone else and the person he gave it to can also be charged with theft if you wanted to push it that far. If you did press charges and it went to court and the guy said that your dad gave it to him the judge would tell him that your dad had no right to give him the car and he can get into trouble for selling a car that he didn't have a title for. He would have to get the car back and give the money back to the old man and the old man would be responsible for the fee that they are trying to charge you. Or the guy that sold him the car might even have to pay that fine and it can still be taken off your record. If I was you, I would discuss this with my dad and see what he says and let him know that you have intensions to press charges. But I would definetly call the place that sent you the fine and let them know that you wasn't driving the car and the car is not in your possession and some old guy has the car but he doesn't have the title and you can't get the car back because of the situation. I would also find out the name of the guy that your dad gave the car too. you will need all the information that you can gather to get this off your record.
