Need help/advice about what to do about my kids being around my mom?

I'm 22 years old and have two children. The father of my oldest has never been in the picture since he was born. I'm engaged now and my son is very close with my fiance and calls him dad. Ok so here's the problem. Since my mom and step dad have seen that my son's dad wants nothing to do with him they have wanted to adopt him. Recently she came to me and ask if I would let just him not my daughter live with them. She says my stepdad doesn't want to adopt a kid he wants my son in their life. I said no of course and then they started threatening to take me to court and take custody of my son & daughter and said they will tell the judge that my fiance abuses my son ) which is not the least bit true). The thing is they are being all nice to me now after they said that but that wasn't the first time. My mom & him have threatened me with that even before I met my fiance and i'm sick of it. I don't ever want my son not to see them but they have been doing this since my son was born.

  1. I wouldn't just move . I'd move out of state ... I'd never give anyone a chance at my child.  Of course , talk to your fiance first ....

      I'd even speak with an attorney to see EXACTLY what rights you have and what rights they have .

First of all, they can't just taake away your child.  Unless there is some extenuating circumstances like you or your fiance doing drugs or something like that, they would never enen have a case.  You should get the heck out of there asap!  I'll tell you, if anyone ever threatened to take my daughter away,family or not, that would be the last time they ever saw her!

  3. First of all they have visitation rights to your children but only to a degree. Unless YOU are doing something wrong or they have physical proof that the children are in immediate danger they cannot have your children taken away. As for the situation at hand, it is time you move out and get away from them.

  4. They can't take your child away and what you need to do RIGHT now is go to the police and just right a report that says your fiance is NOT abusive and explain to them that you want something in writing incase they try to take your son away!

I agree with Sydney L. and depending on the age of your son have him talk with the cops and maybe a therapist to get proof that you fiance hasn't done any thing to him. and if you mom does actually try to take you to court you will have your proof. I hate to mention it, but there is a thing such as grandparents rights too. my sis had to deal with a prob with her in-laws after she lost her husband. If your mom pushes it, then you push back and request supervised visits only. because it sounds like she may try to poison your son against your fiance. Good Luck

    if they want to take your kids there not good parents they shouldnt be able to tlak to you kids or anything thats not cool dude,im 18 and i ahve 2 kids my mom was awsome with them and me (she died last year) If your parents cant be cooldelete them from his life

What a horrible situation!  I'd move, for sure.  They won't be able to get your child.  I've dealt with DHS.  Unless they have witnesses/photos of abuse, or the child admits to it, they don't stand a chance.  The court does everything to leave a child with the parents, even to the point of returning a child to parent in a bad situation.
