Need help on a Visa from England to the US?

My friend is a UK citizen and working in the US. He is dating an American who he plans to marry within the next couple of years. But they don't want to rush into it. His work visa is running out. And the visa application that he just filled out was denied, because of a cap.

Do you know anyone who can help him extend his work visa or get a new one? Are there any companies who help people get their visas?

    There is a pending Classification change for Higher Education Graduates that may help you out. I have included the site link below.

    An application for a visa to bring over a spouse falls under secondary preference.


  2. They could get married right now or be seperated for a few years.

  3. Since his work visas falls under the cap and that cap as not been reached for 2008. There is no way to extend his current work visa.

    If he so wishes he could change his status to F1 (student) or B2 (tourist) but this would end his employment as he would not be able to work.

    Beyond that, the only option for him to stay is marriage.

  4. Usually the company he works for will help him get an extension for his work visa. If, however, his work assignment with them is going to end as well then it's not likely to happen. Did he try to get a change of status? He might try to change from work to tourist. I would suggest consulting a lawyer on this one if he really doesn't want to go back to the UK just yet. Otherwise, there may be no other way but for him to go back home then apply for a fiance visa (if they finally decide to do get engaged).
