Need help on getting my nephew with help with his learning disable?

I have a 16yrs old nephew that has been classifield with a learning disable and has ben in specail ed class his whole time he has been in school and now he is in the 11th grade and I just received them do to family issued and I'm now try to get him retest for his IEP and it been 7yrs since he has had test to see where he is and now the school system is missing some of his testing grades, has place him in a lower grade and states that he is on a cert. track where it states that he want to public but didn't master the skill . Need help on what I should do next. Try not to let him get behind also also need some help on how to get him reading better.

  1. You need to be your nephews advocate. If he has an IEP in place then he is supposed to be tested by the school every 3 years. Call the school and tell them they need to have him reevaluated. I would call a lawyer, find a pro-bono attorney through your state bar. This child has legal rights, especially a right to an equal education. Now that you are his legal guardian call the school and tell them that you want an iep meeting and if the IEP is not to your satisfaction do not sign off on it.

    If his learning disability affects his reading then the school needs to provide teachers adept at teaching children with whatever specific disability he may have. If they do not have anyone qualified, THEY must provide one or pay for one.


  2. The best thing you can do is contact your state's Department of Education.  Tell them you need assistance determining your nephew's rights. They'll have materials and resources they can assist you with.  In my state, we also have a list of special education advocacy/assistance groups in various regions in the state that we can provide. Although there is overarching federal law, each state will have its own laws effecting special ed.

  3. This school has violated so many federal state and district special ed laws that it aint' even funny.

    The people there are VERY qualified to help you step by step.

    From what you wrote, you have a LOT of work ahead of you and since the school is not doing right, you will get a LOT of fighting with them, sorry to say.

  4. so he has a statement ? I assume so ifd he is special ed class.

    If not and is just on Action or Action Plus then ooops comes to mind. The IEP means nothing all kids have an individual education plan - the statement of Sp needs is the real weapon. As he is 16 he is moving out of local authority responsibility and comes under connexions - you need to speak to them.
