I want to get a charge expunged from my record so I can get a job. It is first offense misdeneanor domestic battery. Basically my ex wife was mad at me so she told the cops I hit her when all I did was grab a cigarette out of her hand and throw it out of my house. She was smoking in my house just to p**s me off. around my kids and everything. I deserve to breathe clean air right? well I still put my hands on her so I pled guilty. But now I cant get a job or even go to the college I want to go to. Can someone give me some advice on this?

Depending on your state laws it may possible to have your charge expunged, which means all records of your case must be physically destroyed and is only visible to federal agencies.  Generally you need to fill out an application, obtain a certified disposition of your case, have the state attorneys office office fill out and sign, and have it notarized, then send it to the appropriate department in your state, usually the department of law enforcement.  Then they sent you a certificate of eligibility that you must present to the local courts, then you will get a hearing and a judge will either rule to expunge your records or grant your request.  Its a lengthy process that takes about 5-6 months.  Check your state laws on what convictions can, and can not be expunged.

    Florida law requires you to send your application to the FDLE for approval, you will need fingerprints along with everything else i listed, which u can ussually get from the local courts (in the county you were arrested)  You will probably be required to be present for the final court hearing in which the judge makes his ruling, everything else can be handled over the phone and mail. check out the FDLE website, it tells you everything you need to know, and you can print out the application, and a checklist.  FDLE charges $75 to process your application, and takes 5-6 months on average, the website says a month, but their backed up and that inaccurate.
