  1. I wouldn't waste money on a lawyer at this point. If you truly can't resolve this through normal processes you can ask the IRS representative to make a referral to the Taxpayer Advocate.

  2. You need to give a FEW details. Most of the time you cannot sue the IRS. If she is being audited, she can have a representative help her. A CPA or enrolled agent can help in most civil matters. An attorney can also represent a taxpayer in civil matters and also in criminal matters.

  3. Sounds like they are questioning whether your mom can claim you, and whether she is entitled to something like EIC or has to pay it back.  Any possibility someone else claimed you also?  That's usually what starts a situation like this.

As to your birthdate, if the return was filled out by hand, sounds like maybe the 0/9 wasn't clear.  Although that should have been fixed pretty easily and quickly.

Good luck.  Trying to sue the IRS makes no sense, but a CPA or enrolled agent might be able to help her get all this straightened out.
