Need to know about parental rights?

Me and my ex just recently told our son that I'm not his biological father but that I adopted him when he was about 6 to 9 months old. I was told at the time that there was a possibility of 2 different men that could be his father and only 1 of them was put on the adoption papers. Now the other man which she says is his father has admitted that he might be the father but it sounded like he's not sure and wanta a D.N.A. test done. He has known about him since before he was born and has denied that he was the father for 12 years. since I adopted him and the other man has not been in his life for 12 years what rights does he have and could it change my rights. I don't know if it matters but we all live in Arkansas.

  1. You are the legal father as he signed away or was assumed absentee father in order  for the TPR (Termination of Parental Rights)  to allow you to legally adopt your son. In my opinion it should not change any of the legal status.

    I can certainly understand this is a frustrating situation for you. I highly suggest you contact an attorney to determine your legal options with regard to the custody, support, and the return of the biological father. These sound like pretty serious issues and I hope you are able to speak to a lawyer. Did you have the assistance of an attorney at any time during the original (and perhaps current) proceedings?


  2. If you adopted him, he is legally your son and the biological father has no rights.

  3. Any possible father has the right to get the court to order a DNA test.    If it is his kid, he can get visitation rights.  You have the right to sue him for back child support.
