Need to recover money for car damage how do i and how long will it take to receive money

my1993 volvo was hit by a car and totaled i hurt my back and neck just strained what do i do next how do i recover monetary damages the other driver was at fault and had insurance i went to hosp im fine iam in md im not looking to get rich just want replacement money

  1. The car damage should be covered pretty quickly but the injury money will probably take longer.  Just remember that when asking for compensation, take in all that you are going thru.  The other party's insurance company in looking only at THEIR bottom line and in how LESS that they can get away with.  I know, my husband was killed by an 18 wheeler and I fought with them for 34 months before they knew I wasn't caving in no matter what they pulled.  They tried to smear my husband's reputation, they questioned his helper (my husband owned his own company) and see if he dranked (on and off the job) they went to the church where we attended and asked question about his character, they pried into our marriage to see if we had problems, you named it they did it, just to save THEIR drunk driver. Oh and my life to see what problems I had.(I did have to get an attorney, because God knew I couldn't handle it by myself)  I know that seems extremed but just wanted you to know what you might go thru just to get what is due to you, justly.  Just watch your back, they will be looking after THEIR policyholder, not you or your rights.(just their bottom line)


  2. You should file a claim through your insurance.

  3. if you have not already, you need to contact the at fault parties insurance company and make sure they filed a claim for you.  they should pay for your car,(actual cash value) for a rental car until the claim is settled, all your medical bills, any lost wages due to being out of work because of the accident and if you are lucky a SMALL amt for pain and suffering.

  4. You sue the other driver.  Or you go through your insurance, and let your insurance try to collect from them.

    YOUR AGENT should be walking you through this process.

  5. The only way that you will be able to recover all the damage is to hire an attorney.  The insurance company will only give you book value, and that will not be enough to get replacement vehicle in comparable condition. Th insurance settlement will payfor your attorney costs/

If you have insurance talk with you insurance company.  If you have Collison and comp your company will pay for your losses and go after other company.  IF you only had liablility you will have to try and file a claim with the other party to get get your money for your car.  They should also pay for your injuries under other drivers liablity coverage.  If you dont get anywhere you may have to go to small claims court but this should be your last resort as you will have to put more money out of pocket to do so.  I  wish you well.
