Neighbor crashed into my parked car should i make police report?

She was going in reverse & crashed into my car which was parked across the street in front of my house. We live in Arizona & she gave me a California drivers license & her car has Oregon license plate, kinda fishy ha? Is it not illegal to be using a Ca. license when you live in Arizona? Is she gonna go to jail when i call the fuzz?

BTW The damage is around $1000 & she says her car is a rental

  1. ABSOLUTELY.... if that car is a rental and there's problems, I doubt she will take the fall, they may pursue you for damages if they "think" you are responsible.

    No matter, rental or not or whatever,  you don't want her coming around to bite a year down the road, make a report "and" yourself some notes while the events and times are still fresh in your memory, I'm sure you can ask the cop not to cite her if she was nice about it, you just need a determination of who's fault it was and documentation

    Really you can't be too careful today, people are real sue happy nowadays

  4. If the car is a rental than she signed a contract that the car has insurance on it.

    Call your insurance agent and ask what you should do. You should have asked to see the Rental Car insurance Policy number and contact your insurance company.

I don't necessarily see anything "fishy" here.  She does not have to have an AZ license to drive in AZ if she is a CA resident and lawfully licensed in CA.  If she is an AZ resident she should have an AZ license, but that is not a big offense (people don't go to jail for delay in getting a proper license).  It might be a violation of CA vehicle registration rules if she is a CA resident but registers a car she owns in Oregon, but if it is a rental car that explains that (and AZ authorities are not going to be interested, anyway).

    This obviously was not a hit-and-run, so I don't see any reason to get the police involved.  I assume that AZ has the same requirements of reporting accidents (no matter who is at fault) to the DMV, and if she has any licensing issues, the DMV can take care of it.  You will want to notify your insurance company and hers.

  7. Yes, by all means file a report so her insurance can pay for the damages.  If she doesn't have insurance, you will have to pay for the repairs, and then take her to small claims court to recover your money.

    I DO NOT SEE ANY PROBLEM WITH a California driver's license and presently in Arizona, if she is in Brazil and show you her license as such then it is still valid, as long as she got one. The problem lies if she hasn't anything to present or show you that is the worst problem, driving without license.

    NOPE she is definitely not going to jail for a civil damage such as this one only. You can file a civil damage suit and you can meet her face to face in court. This is not a criminal case so therefore only monetary consideration is at stake.

    Regarding the amount of $1000 you are claiming she can hire her own insurance estimator and estimate the real cost of our car and can demand that you jack up the price of repair of your car which she might claim only $400 only. So it will be a battle between your lawyer and her own insurance lawyer.
