Neighbors above ground pool overflowed and flooded our pond?

We spent thousands of dollars on a backyard oasis. Dug a 200 gallon pond with rock waterfall. Filled the pond with Koi and aquatic plants and what do you know? Our neighbors pool overflowed into our back yard ruining everything during the last big rain . Can this be an insurance claim?

  1. You need to talk to your insurance agent.  Unless you had specific coverage on the pond and contents, I don't think you will be covered.  It's not a building or made for use as a living or storage area.

    Your agent would be your best consult on this.


  2. I would think that you'd have to have flood insurance (you'll just have to talk to your claims adjustor). Don't take your neighbors to court like the other guy said, it's not their fault it rained.

  3. Yes, you can file a claim against them. You can also take them to Small Claims Court. Have proof of your damages.

  4. Honestly I doubt you will be able to claim anything as heavy rain will cause flooding of anything. Had the pool been an above ground one and it split through faulty maintenance then yes, you could claim. You can try but having had experience with insurance companies, unless you specified flood damage, you will not get a red cent. Sorry!
