Question:

New Jersey Simple Assault Charge?

Me and my brother got into a fight. He called the police because he received two chipped teeth out of it. We both hit each other. The charge was 2C:12-1A for simple assault. We both agreed that it was stupid to go through with this. The state is charging both of us. We have our first court date next month. We both wrote in our statements that we were defending ourselves. When we go to court can we simply both agree to drop charges, say we screwed up, and have one party pay for the damages, and be done with it? Criminal records are not good for either of our future careers.

  1. If you each refuse to testify against each other, then the DA's office will find it d**n difficult to prosecute either of you, as there would be no victim's testimony in either case.

That said, I am not a lawyer. You should definitely consult an attorney. Criminal proceedings are nothing to mess around with!
