Question:

New York speeding ticket accused of 74 in a 55. Wasn't going 74 was going 65 what are my options at trial?

I recieved a speeding ticket claiming I was traveling 74 mph in a 55. I was traveling 65 actually and I think he stopped the wrong person. I been interstate traveler from Pa to New york a long time and know generally their pull over threshold is 70 mph in a 55 zone and 80 in a 65 zone for staties on the high way.. So if I was clocked correctly he wouldnt of plled me over in the girst place. What would be my trial options I am sure this isnt an original defense but its the truth from my vantage point. Do I offer a plea for failure to obey a device or for 65 mph any suggestions welcomed

  1. Ask what device was used - it may have recorded it.  Was it some advanced LIDAR or like you said:  stopped the wrong person.  If you find out the device they used, you may be able to make your plan of attack better in court.

    I personally don't think you'll have any fire power to fight this, but I hope you try with success.  


  2. 55 means 55.... thats their pull over threshold. Just because not all of them do it all the time doesn't mean its legal bud. I say take the ticket and everything else. Be a man and own up to your stupidity

Make your appearance in Traffic Court , I'll put money on you beating this ticket not because you were the wrong ticketed car or the equipment used but for the simple fact that Police Officers rarely show up for traffic court. Law states that you are allowed to face your accuser without the accuser present all evidence against you is not valid.

    Your only real choice if you wanna fight it is get a lawyer. There are several things they can argue...

    1. Doplar Effect

    2. Calibration

    3. Tracking history

    But know this...you will probably not win regardless...You will pay the fine, you will pay court costs, and you will pay the lawyer...benefits of lawyer are the lack of points on your license. In my county it goes like this...

    Judge....Officer was the subject speeding

    officer....Yes

    Judge....Guilty
