New york vs. india?

so who has heard that new york is taking the indian embassy to court beause india refused to pay the propety taxes. under the us statute, they do have diplomatic immunity but they still have to pay property taxes. the issue is that the supreme court is using a "living constitution" to determine a ruling based on european laws (THAT AMERICANS DID NOT VOTE ON). if you guys have even heard about it, let me know what you think. right now it seems as though some basketball players got their feelings hurt so no one is really paying attention to the collapse of our constitution and legal system.

  1. If Supreme Court Justices use any foreign law instead of the US Constitution, they should be impeached, removed, disbarred and hung for Treason.


  2. Property taxes are paid to the state where the consulate is located. Consulates must pay any fines, property taxes, etc. to a  U.S. State (not the federal government) as New York is a seperate entity of the US. Embassy are excluded because most embassies are located in the District of Columbia which is not a state and is operated by the federal government. There are a few nations who do have their embassies in New York such as Andorra, Nauru, etc.. because they are very small microstates, however they also use their embassies in New York as their official missions to the United Nations, hence they don't pay property taxes to New York because the UN is considered foreign soil. However, consulates of nations who already have an embassy in Washington must pay taxes on their property as they are outside DC's jurisdiction. They also must pay parking and traffic violations, but are exempt from arrest and paying sales tax (as sales tax is paid on purchases that are made at will not necessity; property taxes are paid on necessity, since a nation must have property to house their mission and staff).

  3. They need to pay their taxes. They would do to us if the US was in India and not paying their bills. I don't believe there should be diplomatic immunity at all.
