Question:

No Contact Order now expired, but was violated when it was active

The situation is this. A friend's boyfriend has been causing problems and was charged with Domestic Abuse and 5th Degree Assault last year.

I have evidence of dated cell phone records, emails, and voicemails from the person who was issued the no contact order valid from July 2007 to July 2008. The OFP (order for protection) is now expired, but has still been causing problems with my friend. Is there a way to present the evidence I have of this person violating their OFP when it was active, even though now it is expired? So they may be prosecuted for violation the conditions of their probation which was the OFP?

  1. i dont think so. you would have to show the order was violated what you have now is showing that an outdated order was violated. if he is still causing problems you can go get another order.


  2. You have to file a police report and if he is re arrested, a judge will give a new order of protection if it's warranted.

  3. Yes, he still can be prosecuted as long at the order was in effect at the time of violation.

    However, the court will question your motive for waiting to report the violations.
