Question:

No Driver's license, expired tag, no insurance - California?

Hello,

A friend of mine was pulled over by a cop in a parking lot because he did illegal crossing on the parking lanes, eventhough they were all empty. He's car was impounded for 30 days and has to go to court.

Does anyone know what is going to happen at court? Many people say that he will get a big fine, and if he fails to pay, he will go to jail.

Does anyone really know what will happen? Will he only be fined?

thanks.

  1. Hey JC

It depends on your friend and his history.  If this is his first offense then most likely it will be a fine and possibly Drivers Ed.  If his history is bad then possibly jail time instead, but again it depends on his history, when I mean history I mean criminal history or lack or criminal history.

The courts tend to be harsher on repeat offenders as were they are more lenient on first time offenders.

Your friend has a jump on things since he has already gotten his car out of the impound, now he just has to show the court that he has his license, the car is registered and it has insurance all of these things will help his case when he goes to court, but if he doesn't have any of it the court will see that he doesn't care about what happen and that will be a negative on his part and the court will come down on him harder.

I hope that helps and that your friend has everything in good standings when he goes to court.

Good luck and take care....Keep the Faith....peace....cya....

  2. I don't know the law in California but I can tell you in most

jurisdications the motor vehicle code or act defines a highway as anywhere a car can travel. This includes public and private parking lots or roads. If he is going to court then

it must be the same as elsewhere.

  3. How is anyone Super Clean if he is so irresponsible to drive and not have a valid driver's license, up to date registration and effective insurance policy?  Dah.......

    Contradiction in terms, there.

  4. you dont have to wait until 30 days.

you better find out where the car right now, what towing company.

go to them and say it that you need the car or make some reason, they will say that you will have to go to police station who make ticket, you go there and ask for release form.

after that you go back to tow company and pay the tow fine,

thats depend on how long the car been sitting there.

usually if passenger car like sedan or any car beside truck is

    $27-$35/day + towing fee ($150)+tax =?

    what happen in court?

    nothing just pay fine.

when your name got called,go to the front and listen to judge say and they will ask your plea, say it guilty, coz if you said not guilty its same like guilty no matter what.

    the cost?

    no insurance = $150-$300

    no DL =$100-$150

expire tag = depend how long its been expires

    no registration = $150

the ticket it self = if you pass solid line =$200-$300

    plus tax court is 225%

so just calculate it what you gonna get.

but if a lot you can ask for arrangement payment,

usually they give you six month and in the last month you ask for extension (3 more month)

if the car worth it ,better pay,

if not worth it just throw it away, leave it,they will sell it in auctions.

    There is no JAIL

but if you can not pay,you do community service.

  5. He may be asked to show proof of all of that in court & pay a hefty fin.  I would definitely be ready.

  6. He will get deported back to Mexico.

  7. If parking lot is privately owned, police has no jurisdiction.

I practiced my driving  in empty parking lot.
