how does the child support determine who gets custody.

I know there are many things that come into play with this. for instance like i have a good job and get paid ok. now on the other hand she don't work no form of transportation well she uses her moms car. would this hurt her or be a advantage for me??? i would like to talk to someone that knows this stuff email me benlopes7@aol.com

  1. Childsupport doesn't determine who gets custody the courts and parents do.  Childsupport is determined after custody is determined. The courts look at many factors in determining who gets custody and prefer if parents can agree to all of that but if not they will have to listen to a lot of testimony about many factors to decide and with some children they will talk to the kids as well and may give them a lawyer seperate from mom and dads lawyers just so they are getting what is best for them.  You need to call and talk to a lawyer who can give you legal advise but just because mom isn't working doesn't mean she won't get custody, as long as she has a place to live and a way to provide for them (foodstamps, medical card and childsupport included) then she could still gain custody as long as she takes care of them.  You could also end up with joint custody if you live within 1 hr of each other and can get along for the sake of the kids.  Just really depends on to many factors for strangers to be telling you what might happen.
