how come when it comes to the dept of children service you can not take them to court even if you are right and they are wrong

You can.  If you want to sue them for damages, you lose.  If you want to challenge their decisions, it happens every day.  As to how to do that, every state is different.  Consult a lawyer.

That's because your state law does not permit it.  You can contact your legislator and see if his office can help you deal with them.

I've also seen investigative newspaper and TV reporters take on this cause if the division is really messing up a lot of cases.
