Question:

Non-Compete Agreement in Michigan?

I recently was let go from a staffing company (internal employee). I was told that it was performance based. Today I received a summons stating that I am being sued because, I have started my own company. I have in fact NOT started my own company, I have filed for unemployment benefits (family to support while I seek employment). I did however have interest in a LLC back in 2006 in the same industry but, I am no longer doing that. Does my former employer have any grounds of me breaking my non-compete? Again I am NOT even working or seeking work in that industry.

  1. You need a lawyer to determine whether or not your interest in the LLC violated your non-compete agreement.  Without seeing the exact agreement you signed, or knowing a lot more about the LLC, it's impossible to say whether your interest in the LLC was a bad idea.

Be sure you get all your paperwork from the LLC that shows when you entered into the corp AND the paperwork that you got when your part in the corp was dissolved.  But get a lawyer.
