Non payment of insurance?

My husband has been having health insurance payments taken out of his check weekly. He was admitted in the hospital on a Monday and died that Friday. I was under the impression that his hospital bills would be paid...now I'm receiving bills from the insurance company stating that he was not covered during this time...for non payment by the company he worked for. I have his pay stubs to prove that payment was taken out of his check weeekly. What can I do...or who can I contact to get these bills paid. I don't have the money to pay them since he didn't have life insurance or a will.

  1. I am so sorry for your loss, and am double sorry that you are having to go through this mess on top of everything.

    I would first approach the employer and ask them to provide you with proof that the employer actually did pay the premium to the insurance company (the only thing I would accept is a copy of check from the bank that the insurance payment cleared or have the human resources manager provide you with a statement and have them call the insurance company with you on the phone)

    Next, I would contact the hospital, dr's, any any misc. depts that you have a bill from to let them know the situation.  You might want to inform them that you have no money to pay these bills and you can provide a check stub that shows your husband's check was deducted for the insurance.  Be frank with them and tell them he had no life insurance or a will, and there is no money that they can try for.  Furthermore, it is not your medical bills (the medical treatment was for your husband, not you) and you should not be responsible.

    Then, I would contact the insurance company and tell them that you need have proof that your husband's payment was deducted for the insurance, and there must be some kind fo mistake.  Do NOT talk to the first, or even 2nd person that you get on the phone.  Do NOT waste your time.  You will need to talk to a supervisor.

    If none of this works, you may need to get an attorney to sue your husband's employer for the default in paying the insurance premium since it was their responsibility and since he paid his portion and you have proof.  I would also sue them for pain and suffering due to the emotional stress they have caused you, and anything else the attorney recommends.

    that's your husband's employer's job.  they deducted for the insurance.  they told your husband he was covered.

    they need to handle this.

    hopefully, the payment was actually made and simply has been misapplied by the insurance company or lost in the mail.

    unfortunately, it may be that your husband's employer is near bankrupt and actually failed to make the payment.

    in that case, you'll likely need a good employment law attorney because you'll have to sue them.

    btw, don't pay on the medical bills.  and don't believe the amounts claimed by the hospital or doctors.  the insurance company probably had discount deals worked out in advance.

  3. First, I'm terribly sorry to hear about your situation. I can't imagine how tough this must be for you even without the stress of the medical bill situation. You need to contact a claims supervisor for the insurance company and diplomatically approach the situation and present your proof of payment of the premium. But, if your husband's employer took out the payment but failed to pay the premium to the insurance company........I would talk to an attorney. I think they could be liable for the unresolved bills.
