Question:

Not paid at all for overtime?

MY hubby stated a new job a few weeks ago it sounded great, they told him it was like salaery. But he wiould make 8.50 an hour. He works about 60 hrs a week 6 days a week and dosent get a penny for any thing over 40 hrs, but if he works less then 40 they cut his pay.

We are in Florida, who do I report them to?(Pratts Landscape, NPR) I have had it, they treaten to fire him, if he dosent work over but wonnt pay him. Beacuse its like salary.

  1. Florida is a Right to Work State.  I do not think you have any recourse.

    But Check with The Dept of Labor.


  2. It's legal, there's really nothing you can do about it.

    Besides quitting of course.

  3. In California, overtime is guaranteed to lower level employees, and the pay rate is 1.5 times the base pay. In your husband's case, since his pay rate is typical for an hourly employee's, I would maybe request to be treated as an hourly employee, since they have to get paid for overtime. I understand that salaried employees are sometimes not paid for overtime, even when they work beyond the 40 hours. This is usually due to the fact that their "hourly" rate is much higher than an hourly employees' and paying them for overtime would vastly increase their salary.  

  4. This is normal practice for salaried workers.  I know it is rough.  Unfortunately there isn't anything one can do or report it to.  I wish that it wasn't that way, because I'm salaried too.  

  5. He agreed to work for Salary and that is what salary is. You work at a set rate for the hours they want and get paid the same. Sorry but he agreed to it, he should have asked questions before he took the job. Sounds like he should just look or another job because no matter who you complain to he had the choice and agreed.
