Notice of Deficiency - Rebate Check?

Hello. I received a Notice of Deficiency for tax year 2006. I have until August to petition the tax courts. My question is that I am scheduled to receive my rebate in July. Will they hold my rebate, or use it as an offset, eventhough the tax hasn't been accessed yet? Thanks!!!

You will probably still get your rebate check since the additional tax has not yet been assessed.
