Notice of seeking possesion?

I have been living in my flat for nearly four years, started a job last christmas, i was earning around £450 a month and was told by the council that i had to pay £187 rent and £106 council tax i always paid the council tax but never the full rent, 3 months ago hours got cut back and i started taking home £318 a month, i was told i had to stil pay the same amount i was paying before, for the last two weeks i have only been doing 8 hours a week so i know at the end of the month my pay is going to be even worse. I got a letter come through today saying they are seeking a notice of possession and taking me to court and that i will have to pay. Does anyone have any advise on what i should do next? Im so scared that im going to lose my flat and be homeless

  1. I depends on what sort of tenancy you have.

    That will depend on who your landlord is.

    It'll be on the Notice itself

    If you have an assured shorthold tenancy you will be required to leave - the court has no discretion.

    If you have a protected tenancy (assured) you may get a suspended order for possession , on terms that you repay the arrears.

    However, if you have no prospect of paying the rent in the future, you're only racking up debt and putting off the evil day.


  2. go down to the council and explain the situation regarding the pay, then go to the DSS and fill in claim forms for income support and council tax benefit. Failing this let the case be heard in court and put across your case that your hours were cut back and you explianed this to the council

  3. Ring the Council Housing department and explain your situation. They will explain what you need to do. If you are straight with them you will find them helpful. Don't sit at home doing nothing. Nobody can help you if they are not aware of your problems. One phone call can ease your mind and in most cases save any possibility of eviction. Good Luck.
