Now that the judge has decided that Texas will retain custody of 416 FLDS children, what do you think?

The judge ruled today that DNA samples will be taken of the parents to match them up with the kids and that for the time being, the state will retain custody. CPS admitted that DNA samples were already taken of the kids.

One expert testified that there is no good answer to this problem. I have to agree that removing children from their parents is damaging and in this case leaving children in the cult is also damaging.

It was apparent that the judge would order DNA testing since she must know who the biological parents are. Legally a judge can't give kids back to non-biological adults unless there is a previous custody agreement. I think everyone should be fingerprinted and photographed at the time of the DNA test so people do not switch places with others.

The decision to retain custody is a good one as it appears that some parents are more interested in regaining their children than they are in following the orders of Warren Jeffs and so the future of the kids will be improved.

  3. My heart goes out to the young mothers that were forced onto marriage and now have had their children taken from them.Does it get more depressing than that?

  4. I agree with the Judges decision. The men in this cult slept with 11 year old girls and impregnated them. If I was one of these girls Mother's I would hunt them down like the dogs they are and shoot them. They are disgusting pigs and have ruined many young ladies lives. I cannot even imagine a child giving birth at that age.

  5. I don't know what to think other than it's a big mess. Haven't followed that closely but if some of the allegations are true it would seem someone needs to protect the children. With that many lawyers and that much media involved is it possible that the right thing will be done?

The state has an obligation to work toward family reunification once a child has been removed.  If these mothers make the changes needed to be protective they will likely get thier children back.  The problem is that no one knows exactly who's child is whos because they keep changing them out or they will not say.  I really believe that when DNA testing is done we are going to find out that alot of the mothers that have teen daughters and infant daughters are actually the grandmother's to these children and that they have taken on caring for them in the presence of CPS or law enforcement in order to hide the fact that thier daughter has been married off.  That is also why they can not consistently give thier last name.

  8. This is so messed up. A phone call that is turning out to be a hoax led to the destruction of hundreds of families. Rumors abound, but there is no proof that any abuse took place. Women are free to come and go as they please and have cell phones to communicate with whomever they wish. How dare we say one religious belief is wrong when we would defend our beliefs or lack thereof to the end? If a few are abusing children, those individuals should be weeded out. We have yet to remove all children from catholics just because some sick priests abused many catholic children.

I will be the first to say that if a child is in an abusive situation that by all means remove the child for safety sake. but the court has no standing if you take the rights away from one you take them away from all. the phone report that was used to start this whole affair was false and why take 416 children when the original complaint was sworn out over a 16 year old

    due process was thrown out the window. you may feel that the state had an obligation to protect the children but there is no Texas statute on the books today that gives the kind of latitude that the CPS has been given only because you don't agree with their lifestyle choice this country was based on freedom of religion if you deny this to them you deny yourself also and your one step closer to a state religion by the dayCPS KNEW AT THE TIME OF THE INITIAL PHONE CALL, that it was from Colorado, CLAIMING THEY WERE INSIDE THE COMPOUND IN TEXAS ...

    CPS took that KNOWN TO BE FALSE REPORT, to a Court, KNOWING THAT IT WAS INDEED FALSE, and they filed against these people – WITHOUT ANY TRUE EVIDENCE, NOT EVEN SOME EVIDENCE ... other than a phone call that came in from COLORADO, claiming it was being made in southern TEXAS. CPS knew this, how else did the Texas Rangers get hold of the information?  By the way - GREAT JOB TEXAS RANGERS !

    CPS Misappropriated the State Game Wardens, Sheriffs and Deputies, State Police, Texas Rangers and anyone else they could rustle up, to go and enforce a KNOWN TO BE A FRAUDULENTLY FILED LIEN OR CLAIM, against an entire community that they had Legislature create new laws for, as they knew the future would have need for the special laws to be waged against FLDS.

    Problem is ... CPS did not have a leg to stand on to even act. For instance, CPS stated or as was written in the news that they had, that they received the initial intake of the complaint, in March ... then again, it was said that February was also the month they took the initial intake of the complaint; however, consider this from the Texas Family Code:

    SUBCHAPTER D. INVESTIGATIONS

    § 261.301. INVESTIGATION OF REPORT.

    “(d) The department shall by rule assign priorities and prescribe investigative procedures for investigations based on the severity and immediacy of the alleged harm to the child. The primary purpose of the investigation shall be the protection of the child. The rules must require the department, subject to the availability of funds, to:

    (1) immediately respond to a report of abuse and neglect that involves circumstances in which the death of the child or substantial bodily harm to the child would result unless the department immediately intervenes;

    (2) respond within 24 hours to a report of abuse and neglect that is assigned the highest priority, other than a report described by Subdivision (1); and

    (3) respond within 72 hours to a report of abuse and neglect that is assigned the second highest priority.”

          ÃƒÂ‚§ 261.304. INVESTIGATION OF ANONYMOUS REPORT.; “(c) Unless the department determines that there is some evidence to corroborate the report of abuse, the department may not conduct the thorough investigation required by this chapter or take any action against the person accused of abuse.” (emphasis mine)

    Please consider just that above. A phone call from Colorado to Texas, to an Agency or Department set up with the necessary equipment to support a MULTI BILLION DOLLAR A YEAR BUSINESS;  certainly, it has caller I.D.

    You have a CPS Agent, taking down the details of the phone call with a recorder running, it shows “COLORADO” on the User I.D., and the 33 year old lady says that she is 16, has an 8 month old baby that was held by another wife of Dale Barlow.

    Let us not even consider;  that, Dale Barlow, has been said, to not have been in Texas for the last 31 years, considering what CPS states.

    I believe you are wise enough to figure out what is going here.

    What evidence did CPS have to show a court – WITHOUT LETTING THE DEFENDANTS EVEN KNOW THAT CPS WAS IN THE COURT PRESENTING THEIR... EVIDENCE AGAINST THE DEFENDANTS ... Defendants were not allowed to show they were cooperating;  but, the pictures of them all falling to their knees when attacked.

    Well – simply put, it does not even matter. Many dim-witted citizens jumped on the band wagon and condemned FLDS for abusing children simply because of the Fraudulently Filed CPS claims that Misappropriated many Official Agencies, Departments and/or etc. to help CPS CREATE ... EVIDENCE at their design.  Indeed, evidence now needed to be created to support the unauthorized acts by CPS, so that they could operate OUTSIDE THE LAW, so that they could illegally take custody of over 400 children that the tax payers would pay $800.00 to $1,600 per month per child, to a foster parent, not counting the Federal Funds of about $3,500 supplied for the misappropriations of the children to begin with and the "pay-off" promotions, paychecks and/or etc. to the CPS Agents who do not have to keep any law or uphold the constitution they allegedly sworn under oath to defend.

    I do not doubt that abuse of many forms is happening in those homes, and although, I know it can be damaging to take children away from their parents - how much more damaging to continue to allow them to be in that environment.

    I think the right decision was made today.

I think that the right thing was done by removing these children from their homes!  I am actually watching the mothers of some of these children on TV as we speak and something is way off about all of them.  Larry King asked them each if any sexual acts took place with these kids regarding older men, or if any of the young girls were married to men in their 20s, 30s etc.,  and they all said no with their heads down to the side, under their breath!  Something is wayyyyy off about these parents and they need to be placed under extreme supervision if the kids are to be returned...investigation should be thorough before the notion of even considering to do so!

  12. I think the judge did the right thing. It is difficult for some of the children in the beginning but they will adjust to the whole outside world with all the counsellings the state will afford them. If their mothers get them back their are possibilities they will end up being abused by the mothers themselves as well as by the messengers of the polygamist JEFFS. All those mothers have been brainwashed by their polygamist leader.They are lying.They avoid answering questions. They give answers not relevant to the question. If those wives have been brainwashed then they  could  do the same to their children. So the judge did it right!!! I hope Warren Jeffs gets a 100 year sentence.

  13. This is an example of the reason we have a seperation of Church and State. Religious freedom exists within the bounds of our country's codes of conduct..our laws. If those laws are broken then we have to step in. Dna testing will finally reveal what victims and witnesses have been saying for the last 40 years- Much older male members of this group have indeed been having children with much younger girls (under 16) for a long time. So long in fact that many of these members are very closely related. The family tree has very few branches if you will....It is no accident that there are so many with similar last names in these communities and it is also no mistake that for many years health care providers have seen a Down Syndrome increase dramatically in the areas of Hildale and Colorado City where this group came from....These witness reports have been going on for years. They have just been falling on deaf ears in Utah.
