She is 78 in the nursing home can't speak well and can't walk..She owe credit card unpaid 2004...

Can collector file lawsuit against her if yes what should she do..

Her doughter used some of her card..

  1. find the free legal hotline that serves the area where she lives, and ask for legal advice on her responsibilities for the debt.


  2. Nice daughter.

    The debt is still hers, her health does not effect that.

    Her daughter should pay this and e done with it.

    However, if the daughter is a complete user the collector will likely have to wait and take it out of her estate.

  3. I suppose if she still has a pulse she's liable for the debt, no matter who she allowed to use her card.  A collection company certainly can pursue her for the money owed, although unless she has some income or real estate they aren't going to get anything.
