When I make a right turn going out from a gas station that doesn't have any stop or yield signs or driving straight across a street to a restaurant, who has the right of way: the other driver making a left turn, coming out from the restaurant parking lot or me?

  1. You have the right of way turning right onto the street over the guy turning left from across the toenter the same roadway. But it's not worth getting into a pissing contest over. Let them take it if it's so important to them.

But you cannot legally cross all lanes of traffic to drive directly across the street.

  2. You have the right of way. You were on your side of the road the other driver had to cross his lanes to come into yours. Of course if he started before you then he has the right of way. But if he didnt and just jetted out he was in the wrong.

  3. The cars that are driving in the street have right of way over the cars that are trying to get onto the street from gas station, restaurant, retail store etc.

There is an invisible implied stop sign.

Thou shalt not enter traffic until it is safe.

This means that certain retail places you don't drive into their parking area in the first place during certain hours of the day, because exiting safely is not an option.

  4. You would.
