Question:

Obstruction of Passageway in Travis County, TX. Consequences?

What are the consequences of pleading "no contest" to this charge (getting DWI dismissed and this charge instead)? Obviously better than DWI conviction and it's consequences. I was given three choices. 18 months probation for obstruction of passageway charge or 2 years probation "deferred adjudication" and lots of community service OR 15 days in jail (2 for 1) (work release is something i know i may be able to do), no fine, no community service, only court costs.

I'm thinking REAL hard about just taking the no contest-obstruction of passageway with the easy jail time.

My question for the most part is...what are the consequences past this? Can I expunge, non-disclosure whatever...what about surcharges? Trying to find stuff but a lot of stuff is not very clear. Thanks ahead of time for your time into this.

  1. Take the deferred on the obstruction.  You can get an order of nondisclosure 2 years after you are off supervision.  There is no surcharge for this offense.  If you take the dwi you'll have to pay 1000 per year for 3 years and you can't get an order of nondisclosure.
