Ohio- custody laws for seventeen year old?

as the title says. i'm seventeen and i live in ohio. i have a temperamental, angry and violent mother and i want to move in with my father. they currently have split custody but she always threatens to involve the police if i stay with him for too long. what does she legally have the rights to do to stop me from moving in with him?

  1. If you google this you can find some info, also is there any Legal Aid or anything where you live who can help you with this?

    Was this custody decided by the court or just agreed on by your parents?

    I think if there's legally joint custody and you just move in with him, she could go to court and enforce that joint custody. I'm not sure whether the police would get involved or not, but she could definitely take it to court if she had the finance/motivation.

    Or, he could apply for sole custody, and your preference would be considered but would not be the deciding factor. (If custody had previously been decided by the court, you would probably have to show that something had changed since then that made you not want to live with your mother.)

    How long until you turn 18? Maybe best just to wait.

    That's the situation to the best of my knowledge anyway though I don't live in Ohio so I had to look up the local law where you are.

    If it's honestly violence, you need to talk to your father about this and you guys might need to involve a lawyer. If you can prove it, then I doubt custody would be awarded to your mother.


  2. My question to you would be, how willing is your father to fight for custody? He will be the one who has to petition.

    Normally, at your age, a judge will take your opinion in to consideration.

    If your mother is that violent, though, you really need to talk to your father and maybe even a counselor at school. No matter what you do, you don't deserve violence or even emotional abuse. It's just as bad and no one deserves that.
