Ok here is the problem! Someone sent the cops over to my apartment saying that they smelt pot rolling out!?

Ok i admit i do smoke pot! But i smoked it last time at like 9 am this morning. The cops showed up at 2pm today. What can the cops do? There was no smoke rolling out of the apartment! And plus we dont have our bongs and pipes laying around ieither! What can the cops do if they dont smell or see anything? Thanks guys!

Honestly, you should be in the clear.  If you weren't smoking while they were there or if you hid everything, then they cannot do anything.  And for this getting a warrant to search your apartment, no judge will sign a warrant on just a neighbor saying that they smelled pot.  Its a too small of a crime, without a big enough payout for all the time.  If you are growing or selling it, that is different.  But if there are LOTS of complaints, they might try.

    Just next time, don't do it in your apartment, go somewhere else.  Or leave the windows open and blow out the window.

  4. They may be able to convince a judge to get a warrant to search your apartment, but I doubt it.

  5. I have little legal experience, but I do watch TV! My guess is that if they suspect you have drugs in the house, they will attempt to get a search warrant issued, and come back to search for drugs. If they find something, you can probably figure out the rest.

  7. The cops don't have to smell or see anything - they only need to hear from a witness who did.  Similarly, judges don't actually see a crime when they either preside over a trial or issue a search warrant.

    Ultimately, what those cops would want to do is get a search warrant.  In drug cases, some judges would allow a warrantless search because it's so easy for drug dealers to flush their stuff before the search warrant entry team does its magic - it's called exigent circumstances.  However, the fact that the cops waited so many hours to get there makes that claim somewhat ironic (that is unless they arrived @ 2pm w/the warrant).  It doesn't matter if your stuff was laying around or not - it only has to be where the search warrant says it can be.  That whole "laying out in the open" defense only applies where's there's no warrant and no exception to the warrant requirement - but the evidence is seen out in the open, visible to a police officer who is standing where he has the right to be.
