Okay back in February of 1983 I got hit by a jeep walking across the road?

my car insurance took care of everything and it wasn't even involved. My hip was totally smashed and my pelvic was shattered. I came home 7 weeks later in a wheel chair and they said I would never walk again so in Oct of 83 I found a orthopedic Dr. in Howell and he put in a total hip replacement. Now what I want to know is 25 years later that hip has gone out and I need it replaced again is my old car insurance still responable for it.?They said they was responable for the rest of my life for anything to do with that accident. Has anyone on here ever had to go through something like that with a insurance and are they responable for it yet ? The Dr that put my hip in the first time said every 10 years I woul have to have it replaced well it has been 25 years but I did what they said and kept my weight down and I got 25 years out of my first hip. Please if anyone knows anything about car insurancece claims please let me know if Auto owners is still responable for my hip surgery

Wow, a Jeep was walking across the road and hit you????Lol.  Sorry to hear about your accident and the trouble it has caused you.  The insurance company should still be responsible because the surgery is required due soley to the injuries incurred from the accident.  Call them, or if you had a lawyer, call him/her and have them call.  There are also usually paralegal services that can give you that information in your area.  You could also ask your doctor, their billing department should be familiar with this sort of thing.  Good luck!

If you got a settlement from the party that struck you, I seriously doubt that they kept the settlement open to future surgeries.  Usually, these are included in the final "settlement".  It is very likely that your file has since been destroyed.  I assume that you kept a copy of your final settlement release.   If you know who your attorney was, you should run this by him.  

    I am really not sure what you mean by, "your car insurance took care of everything, and it was not even involved"?  I assume if your insurance company paid for the medical expenses, then you had Personal Injury Protection coverage.

    However, usually the PIP of the vehicle who struck you pays for pedestrian injuries.  Were you able to stack these coverages?  What state did this loss occur in? Most states have a statute of limitations for this coverage.  In MA it is 2 years to recover PIP benefits.

I'm betting that you signed a release sometime after your hip was replaced, releasing the insurance company from all future liability.  All you can do, is to to go back to the paying insurance company and file a claim.  If you signed a release, they will dig that out and let you know in one h**l-of a hurry......And it won't take long either...   :>)

    Call the insurance company and let them know you need another operation.

    and then you go from there.

    Remember that its been 25 years so there may be some little F-c--k working there who thinks he can deny you  ( and make his skinny azz lok better)

    Meaning you will have to go over thier tiny little heads and get what is due to you.
