On ebay if i want to buy a vehicle and i bid does this mean i HAVE to buy it if i win?

If i bid on a bike say and i say 550 pounds then i go see it to buy it and its not as discribed or as expected is it illegal for me to change my mind about buying it?

  1. If you recently bid, you can retract your bid.  For example, let's say you bid 350,000 and you meant to bid 3,500. Things like that happen.

    If the item is, as you have stated, "not as described" You should be able to RETRACT your bid.



    I bought a $6900 carbon racing bicycle for $2300 (shipping included) due to being granted a second chance offer.

    The seller may have what is called second chance offer set up. This is where if YOU bow out of the deal he/she will e-mail the second place bidder and offer them the item (That was me - and the seller had already been screwed twice before on the deal). I would consult your conscience and then use EBAY LIVE option.  It can be found on the EBAY homepage.  This will enable you to chat with the people at EBAY people about your issue...  You wouldn't want a bad rep, called "being a deadbeat bidder" on ebay.  Especially if you plan to use EBAY often and want to establish a good clean reputation as a buyer ... or seller.  Best of luck to you with this issue and with getting the bike.


  2. Yes except for special circumstances in which you just described such as change in information or not it doesn't look like as the seller describe's the product. Remember you have to be careful what you bid on on ebay because you have to pay the seller.

  3. It is your responsibility to verify the item to be what you expect BEFORE bidding. Your bid is a binding contract to purchase the item.

I walked away from a deal, the owner had taken some very particular photos, the detailed description did not mention the ACCIDENT DAMAGE! and the car was not in a roadworthy state.  I would have got BANNED for driving it!  I told him it wasn't for me, and he gave me negative feedback, I did the same for him, it's no big deal.

    If he is honest and describes it an a project, unroadworthy that is one thing, if he says it is in use, with MOT and can be driven/ridden away, then take him at his word, and if it is a death-trap, walk away!  

    Message the seller and ask him to tell you its' true condition, or view it first.

  5. If it's not as described, you're not obliged to buy it, but it must be pretty obvious that the description was misleading or incorrect.

    Example :

    "The Seat is like new."

    When you go to collect the bike and the seat is ripped and badly repaired with gaffer tape then it is not like new and the item wasn`t described correctly then you do not have to purchase the item.

    However when buying a vehicle it is alway advisable to go and inspect it first before bidding.

  8. If it isn't as described then it would be completely fine for you not to pay for it. You would have proof that it wasn't what you wanted. If it is, however, as described you can still back out but the person can  report you to eBay and could ultimately have your profile deleted.

  14. It is not illegal, but you would need to file with ebay as fraud on the other parties invoilved. There is a simple online form to file that states that the person holding the auction for the vehicle has made disclaimers about the vehicle that was not truthful. You just tell them that after seeing the vehicle in person you realize that they person holding the auction was lying about the item in the auction and was misrepresenting it as fraudulent. Then there will be a dispute on the other party and the item he is selling will have a warning against it next time he posts it. He might give you a bad mark, but you can dispute the bad mark as well.

    It is a contract when you bid, but ebay knows there are crooks out there and they know that you aren't expected to pay for something that is not what it appears to be online.

    They do not sue, and they would look stupid in court if they tried.

    Ebay gives vehicle sellers certain priveledges for when a buyer backs out. They give them the option to repost for free or the seller can contact the person you outbid and sell it to them. They will not be hurting at all if you back out. You have ten days to decide.

  15. i have bought and sold several vehicles on ebay,

    if the vehicle is not as described you can say no and thats why almost all the vehicle sellers ask for secuity deposit within 24 hours. always go and check vehicle before buyig, if you already bought it try to find if something is not as described.

    in case you still dont need the car you can pay him listing fee and apologize to him. and they will get back the final value fee once you will sign the form of no sale.

    its not a big deal even if you refuse to pay for the car you won.

  17. no, but they will leave you a bad feedback, so if you try to bid on something else the person auctioning the item may not accept your bid

  20. If the bike differs from the explicit description, you can open a dispute and refuse to buy it, yes. If the description is unclear, ask the seller about the vehicle. Their correspondence through the eBay email/ message system that describes the item or selling process counts as the item description, too: so any deceit here is also grounds for refusal if you then make a bid, or increase your offer.

    Edit: sellers no longer can give feedback, so don't be afraid of revenge in the form of negative feedback.

  22. It's an Auction, and the top bid is legally binding. You have to pay to get your hands on the goods. If they are not "as described" you can undo the deal through the Ebay dispute procedures. If you just walk away you can be banned from ebay and sued for the money. you would only have to pay the difference between your bid and what the bike actually went for, plus any re-listing fees and legal costs.

    That's why I don't use Ebay

  23. You are not bidding to LOOK AT the item.  You must buy it.  It's an auction for the item.

    Now - Armed with this information, you BID ACCORDINGLY.  That's the piece that's missing.   It's not your right to back out like a sissy that is the problem.  What's missing is you aren't planning to bid accordingly.
