  2. Such a law exists in britain and its called parole I think this can exist in states too. Parole is where after minimum sentence is served they can be free'd for good behavior. If there is a miscarriage in the justice system i.e they find the real offender the person can be free'd immediately and can sue

  4. As ridiculous as it sounds, in the US it is possible to be freed on bail pending an appeal.  Luckily, it's pretty rare.

The only circumstances in which you can make a bond is if a Magistrate or a Judge sets a monetary bond and you can come up with the cash, go thru a bondsman and usually pay 15% of the total, or put up someone's land to bond them out.  Once a Judge sentences them to jailtime, no bond is allowed.  They stay incarcerated until (if that's the case) a parole hearing comes up.

    So if they have been sentenced, and have appealed the decision, and its been granted, an application for bail can be lodged until the hearing for appeal. Therefore the accused can get bail after been sentenced.
