One DWI in TX and two in NJ, does that count as third offense?

A friend (who is an idiot) got a a dwi in TX about 5 - 6 years ago, on in NJ two years ago, and one in NJ last week.

I am wondering if this counts as his third in NJ... as in loss of lic. for ten years and jail time. For personal reasons I kind of need to figure this out as his situation effects my financial situation. LONG story : ) However he seems to think that it only counts as his second offense since only two were in nj.

He is a drug addict and has a drinking problem. For his saftey, and saftey of others on the road I hope it will cause him to loose his lic for ten years. He deserves it.

Any input is appreciated.

In Virginia you can get a felony after having only three prior DUI convictions.  Convictions for DUI from other states also count as well.  I think if the court and the arresting officer find out about this he could be charged with a felony...

After reading your question it appears there were FOUR DWI's not just three.

None the less...a DWI appears on ones "criminal history" and as such it doesn't matter where the offense occurs.

In my own jurisdiction, the fourth DWI conviction becomes a felony offense therefore the defendant is facing more serious problems than in their past!

Likely a third offense but it bepends on the DMV, COURT, OFFICER & him in what he says.

2nd office is not a light offense also.

Sometimes you need to let people go... before they drag you down.  Don't support him, all you are doing is enabling his behavior.

You don't need to figure ANYTHING out - Dump him NOW!

Your financial situation will improve because you won't be burdened with this drunken doper....  IT NEVER WORKS OUT FOR THE POOR ENABLERS WHO SUPPORT THESE PUKES.

If you really want to help him, let him bottom out away from you, then see if he dusts his a$$ off and picks himself up.  If not - you don't need to be around him.  It never ceases to amaze me how many women think they can fix these human emotional black holes....
