That is actually a grey area.  When a member in our  group a couple years ago was going through chemo therapy she needed one of us moms to h-school her kids.  The State of MD states that the parent/legal guardian is responsible for homeschooling their children.  The term 'responsible' is what is causing some debate in the aisles on Capitol Hill and in Annapolis.  Does that mean that the parent is responsible for designating someone to h-school her child(ren), whether it be her or a tutor?  Or does it need to be a custodial parent/guardian that does the h-schooling herself.  

    HSLDA recommended that she have a document drawn up designating that Ms. X was tutoring her child during the months of "x", "y", and "z", in order for her bases to be covered.

    When my husband and I re-drew our wills when we started homeschooling, we have it designated that a certain mother that is close to our family will take over homeschooling and record keeping.

  3. No, it is not illegal.  There are notification and evaluation regulations in MD, but no qualification regs.  It is perfectly legal (according to the info on HSLDA) to hire a tutor (whether it is a teacher or another homeschool mom, paid or not) to homeschool a child.

    The parents need to keep records, and the child will be evaluated, but there doesn't seem to be any law stating that it is the parents that must personally provide the instruction.
