Question:

Online court records?

Hi,

Is there any sort of statute of limitations on online court records? My sister has several speeding tickets from the mid 90's that are still showing on our state's (Iowa) online court system.

Do these things ever go away?

Thanks,

Daisy

  1. they will never leave but they should say open or closed ... if its closed there is nothing to worry about its done ... but they will stay in her records forever just so if something else happens they can look up what u have done in ur or her past

  2. Statute of limitations is the limitation of time from when a crime is committed till the person is charged. It does not apply to convictions. Conviction records are permanent.

  3. Normally an "abstract" of your driving record only goes back to three or five years depending on the state you live in.  Some states allow YOU to look at your entire record, but no one else but law enforcement may see the rest of it.

As stated before the statute of limitations is only the time between the crime committed and the time it may be prosecuted.  If you get a ticket in Texas and don't pay it or show for court, a bench warrant is issued; however, nobody comes looking for you.  If you are found within the statue of limitations (such as four years) you may be prosecuted.  If the limitations are exceeded, the bench warrant expires and there will be no prosecution.  That said, you have to be very careful because the expired bench warrant does not evaporate and may be found if you come back to the state where it was issued.  It can be like a rattle snake waiting to bite your A$$!
