Question:

Opinion for a near car accident?

I was pulling out of the parking lot with my little brother and we started to turn right onto the main street to head home. Directly in front of was a left turn lane for drivers to be able to turn into the parking lot that my brother and I were leaving. Assuming that the car was going to turn into the parking lot I proceeded to continue to drive out, the girl didn't notice me until she began to make her U-turn and almost smacked into our truck, both of us slammed on the brakes just in time.

If we did hit, I wanted to know whose fault would it have been? I wanted to know if I made the mistake or did she because I never want to get into an accident.

  1. If you had your turn signal on to show you were turning on to that street, the gal should have known you were going to be traveling in that lane she was turning into.   I'd say the accident would have been her fault.  

    Were you at a traffic light?


  2. The person on the main road has the right of way.  You are lucky you didn't get hit because it would have been your fault.  Stop assuming.

  3. In most jurisdictions a U turn is not allowed within 50 feet of an intersection if it's allowed at all, so it probably would have been her fault.  Luckily you won't have to sort it out though.

  4. Umm in this case the fault would be urs cause when people indicate to go in to someplace, it could also mean they are u -turning, unless there was a no u turn sign, that would have been her fault, just be more careful next time!

  5. It probably would have been the other persons fault since they most likely were attempting to do a u-turn where they shouldn't have been. However, try not to assume anything when it comes to other drivers because you just never know and that's how accidents happen. Good luck.

  6. it does not matter if it is at a light or not. if you are entering a roadway from a parking lot you must give the right of way to any vehicles on the roadway. the first rule of safe driving is" think of the dumbest thing the other driver might do, then wait for them to do it"

Good question, but if her light was green and yours was red, she had the right of way, assuming that U turns are allowed at the intersection.  However, If she would have hit you from behind, the accident would have been her fault because you would have been in front of her.  But, even if she hit you from behind, you would still have needed to stop at the red light before turning.

    Edit--Since you said it was not a light, I doubt if the U turn she made was legal.  In that case it would have been her fault, assuming that you stopped before turning.

  8. Sorry to tell you this, but if she was at a light (and it was green) then she had the right of way. NEVER assume something, even if someone has a blinker on dont assume they are turning... sounds silly i know, but its true!!

    You would have gotten the ticket "failure to yeild"

    Okay! Then it was totally her fault! LOL... but still you said that you "assumed" she was turning into the parking lot and then almost got hit when the douche made a (probably illegal) U- turn)... So I just say next time you see a car in your lane, just wait a few seconds to see where they are actually going before you make your turn. There are some Dumb*** drivers out there!! =)
