Opinion moraly/ ethicaly if a police officer wants to go back to work for the Califronia highway patrol @63?

The officer retired at age 59 due to injuries and wants to go back at age 63.What does the Califronia law say about it and is the officer going to win in court?why?(the officer is back to normal after rehabilitation).

I need to write about it from an ethical ,moral point of view but I need also to show a case supporting it or a law.

  1. Usually he will have already passed the age cap for hiring and wouldn't be able to be rehired.  Besides, at 63 why isn't he considering retiring?


  2. I don't see how you could write about it from a "moral or ethical" point of view. In my opinion it has no bearing on ether. If the guy wants his job back and he can still do it, (which I would wonder about) then it is just a process with the department and maybe courts.

  3. In Illinois, if an officer is injured on duty, he may end up on disability. At any point during that period, the agency can make them take test to see if they are fit for duty and can have them come back or let him go into regular retirement.

    Not really an ethical or moral problem. Most likey a fiscal problem. There is also a big difference in retirement versus disability pay. If you were on disability for 5 years. your pay would likely be less than if you came back to work for a year or so and then retired at regular rate, even though disability may have paid a higher precent, at a fixed amount.

    Strictly fiscal issue and usually the agency has as much protection on the outcome as the individual

  4. They just had a police officer locally who was 59 and went back to work for a police deparment.  He was able to pass the academy requirements.

    He was retired FBI and was originally a police officer.  I think he'll be a great addition to the department.

    If he is able to meet the physical requirements and perform the job then it's okay.  It's illegal according to federal and state law to discriminate due to age.  Look up federal or state law regarding age discrimination.
