Other party hit my car, can I ask for depreciation on top of repair? If so, at what percentage can I ask for?

  2. Depreciation will devalue the cost of car (and the money from the repair).  do you want less?

    The value of repair will be "depreciated" according to the age of the car.  It is only reasonable.  Otherwise, they will have to buy you a new car - if it was totaled.

  3. Not all states allow claims for Diminished Value.  You also have to prove that the vehicle did lose value.  Just because it was involved in an accident does not mean that the value has diminished.  

    You probably need to do a little on line research.

  4. If it's a late model vehicle with a relatively high resale value, then yes you can and should ask for what's called diminished loss of vehicle value due to the accident.

    Even if the vehicle is repaired as good as new (or better than new), there's a perception in the market that a vehicle in an accident isn't worth as much as one that never has been in one.

    Percentage is hard to say.  Depends on the vehicle, of course.  And it won't happen if the vehicle is more than 3 years old (unless it's a classic or something).

    But if it's late model, I'd say at least 10%

  5. Your insurer can only restore your vehicle back to what was originally (indemnity) and more importantly depreciation of the vehicle's value unless it is has an agreed value on your policy will not be covered.
