Other partys insurance paying rental?

i took my truck to a mechanic on tuesday and they didnt latch my hood. when i drove away, it opened while i was driving not 2 blocks from the shop and caused 2,300 in damages. my truck has a busted windsheild and a hood that doesnt close among other damages. this truck is not safe to drive and i need a car, especially with school starting monday. what do i tell their insurance company to cover the rental fees? i already made a claim yesterday and sent in an estimate from the bodyshop. BTW im in california

  1. Your in a tough spot here they are going to say the latch was faulty and you should of had it fixed not there fault. It's going to go on your insurance and you probably will have to take them to small claims court to recoup your monies spent.


  2. Tell therm the exact same thing that you said here and insist that they pay for the rental. The last time this happened to me, I told them that since my van was damaged, I would be renting another van. They didn't like it, but they payed for it.

  3. this actulally happens more times than people know.

    The shop would owe for the damages but you have to prove it.  they should call their insurance and make a claim.  After the investigation if they find  their mechanic was negligent they would owe for the damages and a rental car as a courtesy.  but you may have to wait till the investigation is complete.

    If you carry comprehensive this would be covered under comp.  It is not collision because you cannot collide with yourself.  You would be out your ded right now but your insurance company will try to recover that back for you from the at fault party.  If you carry rental reimbursement you would be owed a rental vehicle from the time that you're vehicle went into the till it's repairs are complete.

  4. I have to ask how fast you were driving that your hood opening could do that kind of damage!  You sure as heck weren't doing the speed limit of any city that I know of, unless you were driving into a headwind over 60 mph.

    The other thing I ask is, how could you not notice it?  Hoods have a double latch.  One is fully closed, the other is the safety hook.  A hood sitting on top of the safety hook is more than an inch raised, and that should be visible even from the driver seat.

    Sorry, but it just sounds odd, and I imagine, before they even think about a rental, they will ask you the same questions, so be prepared.   How do you prove you, or somebody with you, didn't open the hood to look at something?

    I am an insurance broker, vehicle registrations agent, and driver licence issuer.  I have also been driving for 43 years, close to 2 million miles, and have never seen an accident like yours that didn't happen at high speed, and never in city limits, except on a freeway.

    I carry no-fault replacement transportation coverage on my policy, so it pays for a rental starting immediately after I report an accident to the insurance company, or, in off-hours, to the police.
