Other ways me and my girlfriend can marry and spend our lives together in the USA?

I live in the UK and my girlfriend lives in Texas in the USA, now i've just been informed that the USA Federal Government wouldn't recognise a g*y marriage so I wouldn't be eligable for a Spousal Visa and so on so how can I get myself legally into the USA to live with my girlfriend/future wife?

Preferably the fastest cheapest LEGAL way.

  1. Cheapest is probably to get into a university near your partner in Texas and go on a student visa.  Get a graduate degree while you're spending time with your partner.

    Other than that it will probably only be limited travel visas for you.


  2. There is no legal way to get visa based on same gender marriage in US. US Immigration Law which is Federal Law do not recognized same gender marriage.

    You can try get immigrant visa through US Employer, which is actually very long wait. But that would be your other choice.

  3. Yes, as a same-s*x spouse, you won;t be eligible for a spousal or immigrant visa to USA.

    You can get a Student visa (if you have an intend to attend school/college/grad school in USA). Please note that you must actually attend school, it cannot be used as a tool to enter the USA.

    Other option, a Work visa (depending on your education and work experience). Or an Investor visa (immigrant or non-immigrant), if you have a significant amount of money to invest into USA, then you can start a business and get an Investor visa.

    The UK citizens are not eligible to participate in a DV lottery, as someone suggested. So you have some legal options, but they are limited.

  4. Well you keep pushing for a way, but it's just not easy.

    The ways for an individual to come to the US to reside and work are:

    1) Marriage to a US citizen and subsequent adjustment of status (K class Visa)

    2) Sponsorship by an immediate relative who is a US citizen (IR/CR visa)

    3) Sponsorship by an immediate relative who is a Lawful Permanent Resident (IR/CR visa)

    4) Internal company transfer from the UK to the US (L1 dual intent visa)

    5) Participate and be selected in the Diversity Visa Lottery *

    6) You own or buy business as a national of a qualifying Treaty country (E2 visa)

    7) An investor with at least $1million in assets (EB5 visa)

    8) Assist US law enforcement to investigate and prosecute crimes and terrorist activities such as money laundering and organized crime. (S visa)

    9) Get a member of Congress to sponsor a private bill with legislation that applies just to you.

    Those are also listed in the order of how likely they are to happen.

    * Not applicable for UK residents.

    #1 is out for you since same s*x marriages are not recognized at a federal level or by any provision of the Immigration and Nationality Act or Code of Federal Regulations.

    You could look at going to a university in the US, but that's not permanent.

    At the current point in your life, and in your situation, it's pretty much an impossibility for you to move to the US.

  6. Bring her over to the UK where they have civil unions. That would be the easiest way to be together. She could come over and live with you. :-)

Look !!!!   g*y marriage will become a part of immigration law someday.  But now it is not recognized.  There is no sense coming here to commit immigration fraud because it will all come back to you in the end.  You need to have her move over with you and forget about coming here entirely unless you want to be here for a purpose that meets the federal regulations.  Geeez!!!!!

Since you haven't started hormones yet or gone through any surgery I guess you could just wait longer, marry her as a man (so that the marriage would be recognised by Federal law) and then have a s*x change in Texas. That way round you' definitely have to pay for the surgery out of your own budget though. Otherwise, you could try the student visa, with the downsides already mentioned by other answerers, or bring her to the UK (although she might not want to leave family and friends).
