Question:

Our Company knowingly and willingly exposed its employees to asbestos? Is this ground for a lawsuit?

I currently work for a construction company. My job is to unload a truck full of waste materials from the work of the prior day. I do this every morning. I just learned that the waste materials I have been throwing away and handling every day for 6 months are asbestos pipes. I then found out that not only the company knows about this but the city the project is being done for know about it as well. When I asked a question about it a supervisor said "it wont kill you"! Other employees have also come into contact with large amounts of it as well. Is this ground for a lawsuit? and if so how much compensation would you estimate it to be worth? Please only serious answers Thank you!

  1. Refuse to unload it, let them fire you, collect unemployment, and hire an attorney to sue them.

Or go to the EPA or any law enforcement and report it. You then have protection under whistle blower laws. And a lawsuit.

Feel free to contact me as I am in the midst of a somewhat similiar legal situation. The steps you take will greatly impact any potential suit. I also have the e-mail address of an EPA investigator in the TX,OK etc area. He helped get an investigation rolling here in Texas.

  2. contact the OSHA in your area your employer will receive harsh punishment. you definately have a lawsuit dont back down

  3. are you being provided with proper safety equipment to do so? if not OSHA and lawyer are the way to go

  4. Yes, you have a lawsuit - and if there are minors involved, a criminal case.
