Our Visit to U.S. New Jersey, was on B1:B2. Its been more than a year. Have a issue reg. reply from USCIS?

Me & my Wife got 10 yr. multiple visa. After immigration, 6 mths stay in U.S, New Jersey. We applied for extension in August 08 as deadline was near. We didn't get any response since then. Now we received a letter "Denied" and letter also says "If you believe this decision to be in error, may file a motion to reopen on Form I-290B." Also: the pursant to title 8, code of federal regulations, part 103.2(b)(8). I want to know weather we are in status or not. What can be done to be in status. My Lawyer said, you can open the case and put it on hold few months. How far is our status and situation... Genuine answers are appreciated.

  1. You are now out of status.  If you leave within a few days the overstay is likely be be overlooked.  Save the denied letter so that you can account for why you overstayed.

    If you just blow it off, and stay more than a few days, your visas will be canceled and you'll be denied entry the next time you try.

    You are here in non-immigrant visas.  I don't know what you expect an attorney to do for you, but if you stay "a few months" it will be the last few months you'll stay because you'll never get back in.
