  1. Read your contract with your initial lawyer.  There is usually a clause stating what happens if a case is transferred to another attorney.  The clause I have seen most often is that a transfer does not affect your fees and any retainer balance will be transferred to the new attorney.  


  2. A retainer fee is a deposit on the work to be done.  It is not something you lose - it's just put towards the balance that accrues.  If there is anything left over, it is returned to you.

    The new lawyer should have you sign a new retainer agreement which spells out his billing fees, etc. and whether he requires a retainer or whether the balance has been transferred to him or returned to you.

  3. No, that should be transferred as well.

  4. No, your original attorney will get a percentage of the total cost. Your fee will remain the same.
