Overtime Travel - California?

Say you have a meeting on Tuesday that lasts 4 hours, and choose to travel Monday evening to get to that meeting. Does the time spent traveling on Monday count as overtime because you spent more than 8 hours with work+ travel, even if you don't work more than 40 hours that week?

  1. the time you wonder about is addressed in labor law.

travel time that is in your car that is to a work assignment outside your normal area of work is considered work hours however what you propose is you driving on Monday when it is not a necessity.

if you, by your own choice, leave a day early then that is not work time or overtime in California. if you get up and drive on Tuesday then attend a meeting and drive home on Tuesday and exceed 8 hours in doing so then on Tuesday there would be overtime. if the employer requires you to drive on Monday then yes that time is overtime if you have exceeded 8 hours for the day.

in California the total number of hours in a week does not effect the overtime for working in excess of 8 hours in a day or overtime for working a seventh day in a work week.
