Owner sold home when they signed lease agreement 2 weeks ago.?

I signed a Residental Lease agreement on August 14th to move into the home September 1st. The Owner of the home told me that the house was for sale when we talked to them in July but they told me no one has shown interest or gave them a purchase agreement. On August 28th (after I packed up everything and I broke my apartment lease), a day before they were going to let me start moving in, they called and told me they were going to sell the home and not renting. I am furious, is there anything I do for them cancelling the agreement?

  1. It is impractical to sue, it would cost more to pay the lawyer than you would get out of it. If you have incurred expenses like storing your furniture temporarily, and lost your apartment and you are living in a motel, you could look and see if there is a landlord/tenant court in your state, and file suit yourself. You can also see if you could start a small claims action. Other than that, the costs to litigate will soon surpass the loss you sustained as a result of their cancellation.That's a tough break.  Best of luck to you.


  2. You might have a case you could win that would allow you to live in that house for 1 year.  A Small Claims Court would award you possession. Pay $35 at the court.

  3. Check your rental agreement, you should have tenants rights that transfer to the new owner.   What the owner is doing is against landlord/tenant regulations, if you have committed lease, the new owner has to honor the lease until they can complete the eviction process and boot you out.  

    It may be more hassle than its worth to pursue this, but I can certainly understand your frustration.
